The city
named Industry
became the
54th municipality
in Los Angeles
County theoretically
this morning
when county
supervisors
certified
the results
of the Dec.
4 election.
Papers were
flown to
Sacramento,
according
to councilman-elect
Darius Johnson,
for official
ratification
by the secretary
of state.
Industry's
city council
will hold
its organizational
meeting
Thursday
in a conference
room of
the Utility
Trailer
Sales Mfg.
Co., 17300
E. Chestnut
St., Beginning
at 8 p.m.
The actions
followed
swiftly
abandonment
of court
litigation
contesting
the validity
of incorporation
proceedings
yesterday.
Opposition
to the controversial
city, which
will occupy
five square
miles of
industrially
zoned acreage
cradled
by the Southern
Pacific
and Union
Pacific
Railroad
south of
the city
of La Puente,
apparently
has been
abandoned
after an
injunction
against
Industry
was dissolved
by the District
Court of
Appeals
in Los Angeles
yesterday.
Action to
block the
incorporation
was dismissed
by the Appellate
Court upon
the motion
of Atty.
John B.
Surr, of
San Bernardino,
representing
Walter F.
Payne, of
Los Angeles,
owner of
property
within Industry's
boundaries
and litigant
in a law
suit against
county supervisors.
In a preliminary
movie that
brought
a sudden
end to the
prolonged
suit, Surr
was substituted
as attorney
for plaintiff
at Pyne's
request
and replaced
Attys. Warren
E. Ferguson
and James
Judge, who
had handled
the case
through
the trail
court.
Judge said
yesterday
it was "unfortunate
that the
appellate
court was
prevented
by Pyne's
action from
considering
the basic
question
because
of the important
principle
of involved."
Basic dispute
was over
Industry's
right to
incorporate
with a population
that included
patients
of a private
mental institution,
without
which the
city would
have lacked
the 500
inhabitants
required
by state
law governing
incorporation
proceedings.
Ferguson
and Judge
went on
record opposing
the dismissal
of the case
by objecting
to the substitution
of Surr

representing
both municipalities,
however,
expressed
willingness
to "work
together
to resolve
mutual problems
now that
the litigation
is resolved"
